Fractional CMO may publish testimonials, endorsements, quotations, case studies, or other statements from clients, collaborators, industry professionals, or other individuals. This Disclosure explains how those statements should be understood and how material relationships are disclosed.
What Testimonials and Endorsements Mean
Testimonials and endorsements reflect the views, experiences, or opinions of the person making the statement at the time it was provided. They should not be interpreted as a promise, guarantee, or representation that every customer, client, or member will have the same experience or achieve the same result. A statement may be edited for length, formatting, spelling, or clarity, but Fractional CMO should not edit a statement in a way that changes its material meaning.
Results and Earnings
Marketing, revenue, profitability, customer acquisition, conversion, and other business outcomes vary widely. Results depend on factors that may include the business model, offer, market, budget, team, execution quality, timing, competition, economic conditions, and other circumstances outside Fractional CMO's control. Testimonials describing revenue, savings, growth, return on investment, lead volume, conversion improvements, or other quantified outcomes are examples of individual experiences and are not necessarily typical. No testimonial or endorsement is a guarantee of future performance.
Individual results vary. Past performance, testimonials, case studies, and examples do not guarantee future results.
Material Connections and Relationships
When an endorsement is made by someone who has a material relationship with Fractional CMO, that relationship should be disclosed clearly and close to the endorsement when the relationship would not otherwise be obvious to a reasonable visitor. A material connection may include, for example:
- a current or former client relationship;
- payment, compensation, gifts, discounts, free services, or other consideration;
The disclosure should describe the actual relationship. Fractional CMO should not use a generic statement such as "results vary" as a substitute for disclosing a material connection when one exists.
- an affiliate, referral, revenue-sharing, or promotional arrangement;
- a founder, employee, contractor, advisor, speaker, partner, or other business relationship; or
- another personal, professional, or financial relationship that could affect how a visitor evaluates the endorsement.
Permission to Use Names, Images, and Statements
Fractional CMO intends to use a person's name, photograph, likeness, quotation, audio, video, title, or testimonial only when it has an appropriate basis to do so, including any permission or release required for the intended use. Permission for one use does not automatically authorize every other use. The scope of any permission should cover the media, channels, duration, edits, paid advertising, and other uses in which the endorsement appears. If Fractional CMO cannot verify the basis for using a person's name, image, likeness, or statement, the content should be removed or withheld from publication until the issue is resolved.
Accuracy, Context, and Currentness
Fractional CMO aims to present testimonials and endorsements in a way that preserves their original meaning and does not create a misleading impression. Context that is necessary to understand a result, relationship, or statement should not be omitted. Testimonials may become outdated as products, services, relationships, or business conditions change. Fractional CMO may revise labels, add context, or remove older endorsements when necessary to keep website statements accurate and current.
Third-Party Names, Titles, Brands, and Trademarks
A reference to a person, company, publication, title, trademark, or other third party does not by itself mean that the third party sponsors, endorses, is affiliated with, or has an ongoing relationship with Fractional CMO. Any such relationship should be stated accurately and should not be implied merely through placement, design, or branding.
How Relationship Disclosures May Appear
Depending on the facts, a short disclosure may appear directly beside or beneath a testimonial, quotation, endorsement, video, or case study. The wording used on the site should match the actual relationship.
| Situation | Example disclosure |
|---|---|
| Client relationship | Client testimonial. Individual results vary. |
| Compensated endorsement | Paid or compensated endorsement. Individual results vary. |
| Business relationship | The endorser has a business relationship with Fractional CMO. Individual results vary. |
| No compensation | No compensation provided. Individual results vary. |
Relationship to Other Disclosures
This Testimonials & Endorsements Disclosure should be read together with the Fractional CMO Earnings & Results Disclaimer, Terms of Service, Privacy Policy, and other applicable notices. If a testimonial contains a specific earnings, savings, revenue, or performance claim, the claim should also be supported and presented with any additional disclosure required for that claim.
