This disclosure explains recurring billing for Fractional CMO advisory engagements and how promotional or diagnostic offers are treated. It supplements the applicable checkout terms, order form, signed agreement, and Terms of Service. If a signed agreement contains different terms for your engagement, the signed agreement controls for that engagement.
Current Marketing Diagnostic
The currently published Fractional CMO Marketing Diagnostic is offered as a one-time purchase. The public diagnostic offer states that it is not a subscription and does not, by itself, enroll the purchaser in an ongoing Fractional CMO advisory engagement.
Purchasing or completing a diagnostic does not authorize Fractional CMO to begin charging $2,000 per month for advisory services unless the purchaser separately receives the advisory-engagement terms and affirmatively agrees to them.
Current diagnostic pricing
As of the Last Updated date above, the public Marketing Diagnostic page lists a $97 one-time price and a 14-day money-back guarantee. Promotional pricing may change. The price and refund terms displayed at the time of purchase control for that diagnostic purchase.
Fractional CMO Advisory Engagement
The current Fractional CMO advisory offer is structured as a 12-month engagement. The published investment options are:

If you select the monthly payment option, you authorize recurring monthly charges in accordance with the checkout terms and your signed agreement. The exact date of the first recurring charge and the billing date for later charges must be shown to you at enrollment or in the governing agreement before charges begin.
The 12-month commitment and the monthly billing schedule are related but distinct concepts: choosing monthly billing does not, by itself, convert the engagement into a month-to-month commitment.
Renewal After the Initial Term
This disclosure does not create an automatic renewal beyond the initial 12-month term. If an enrollment, order form, or signed agreement provides for renewal after the initial term, the renewal terms – including the renewal period, price or method for determining price, timing, and cancellation method – must be clearly presented in that enrollment or agreement.
Where applicable law requires a renewal reminder or other advance notice, Fractional CMO will provide the required notice using the contact information associated with the account.
Promotional or Low-Cost Diagnostic Conversions
Fractional CMO may test promotional offers from time to time. If a promotional diagnostic, trial, or introductory purchase is offered at a reduced price and is designed to convert into a recurring advisory engagement, the conversion terms must be clearly disclosed before the purchaser provides billing authorization.
For any such offer, the checkout disclosure should identify all of the following:
- the introductory or diagnostic price;
- whether the introductory purchase automatically converts to another product or service;
- the amount of the first recurring charge and each later recurring charge;
- the date or triggering event for the first recurring charge;
- the length of the minimum commitment and the billing frequency;
- whether and how the engagement renews after the initial term;
- the cancellation method and any deadline for stopping future recurring charges; and
- any refund limitations or other material billing conditions. A purchaser must take an affirmative action indicating agreement to the recurring billing terms. A diagnostic purchase alone should not be treated as consent to a separate recurring advisory engagement unless the conversion terms are clearly presented and expressly accepted.
Cancellation and Stopping Future Charges
Fractional CMO will provide a reasonably simple way to request cancellation or stop future recurring charges when recurring billing applies. The available method may include a self-service cancellation option, an account-management control, or another cancellation method identified in the checkout confirmation or signed agreement.
Cancellation of future recurring billing does not automatically eliminate payment obligations already incurred under a fixed-term agreement. For example, if a purchaser enters a 12-month engagement and chooses monthly billing, the effect of an early cancellation request is governed by the signed agreement, applicable refund or termination provisions, and applicable law.
Keep your confirmation After enrollment, retain the order confirmation and signed agreement. They should identify the product or service purchased, price, billing schedule, term, cancellation instructions, and contact information for billing questions.
Refunds
Refund eligibility depends on the product or service purchased and the terms presented at checkout or in the signed agreement. A refund policy for a one-time diagnostic does not automatically apply to the separate 12-month advisory engagement.
The current public Marketing Diagnostic page states a 14-day money-back guarantee for that diagnostic. Advisory-service refunds, credits, early termination rights, and amounts remaining due under a fixed-term engagement are governed by the applicable advisory agreement and checkout terms.
Changes to Price or Billing Terms
Fractional CMO will not use this disclosure to retroactively change a price, commitment, or billing term that has already been agreed to. Any material change affecting future recurring charges will be handled in accordance with the governing agreement and applicable law.
Express Consent to Recurring Charges
Before recurring charges are initiated, the purchaser should be given a clear summary of the recurring terms and an opportunity to affirmatively accept them. The authorization should be separate enough from unrelated marketing language that the recurring payment obligation is understandable at the moment of consent.
Fractional CMO should maintain a record of the version of the checkout disclosure accepted, the date and time of acceptance, the purchaser or account, and the payment authorization associated with the enrollment.

Billing and cancellation questions should be directed through the contact method shown in the purchaser’s order confirmation, account, or signed agreement. Fractional CMO should keep those instructions current and easy to locate.
Relationship to Other Agreements
This disclosure is intended to make recurring billing terms easy to understand. It does not replace the Terms of Service, an order form, or a signed service agreement. If there is a conflict, the applicable signed agreement controls for the specific engagement, subject to applicable law.
