Fractional CMO may offer visitors, prospects, clients, or members the option to receive text messages. This Disclosure explains how SMS/text consent is requested, how messages may be used, and how recipients can manage or withdraw that consent.
Scope of This Disclosure
This Disclosure applies when you voluntarily provide a mobile telephone number to Fractional CMO and separately agree to receive SMS or other text messages at that number. It should be read together with the Fractional CMO Privacy Policy, Terms of Service, and other applicable notices. Text messages may be sent directly by Fractional CMO or through communications service providers acting on our behalf. The content and purpose of the messages depend on the form, service, or interaction through which you provided consent.
Consent Is Optional
Where consent is requested for marketing or promotional text messages, the consent choice should be presented separately from other website terms and should not be preselected. Choosing not to consent to marketing text messages does not prevent you from purchasing a product or service or from contacting Fractional CMO through other available channels.
Recommended form standard: use a separate, unchecked consent checkbox. Do not bundle SMS marketing consent into a general Terms of Service or Privacy Policy checkbox.
Recommended SMS Consent Checkbox Wording
The following language is designed for a separate checkbox placed near a mobile-number field when the form is intended to request consent for recurring marketing and informational text messages:
I agree to receive recurring automated marketing and informational text messages from Fractional CMO at the mobile number I provided. Consent is not a condition of purchase. Message frequency varies. Message and data rates may apply. Reply STOP to opt out and HELP for help. See our Privacy Policy and Terms of Service.
The checkbox should be unchecked by default. The wording should remain visible at the point where consent is given, and links to the Privacy Policy and Terms of Service should be available without requiring the visitor to search elsewhere on the site.
Types of Messages
Depending on the context in which you consent, SMS/text communications may include:
A form should not describe one category of messages while using the consent to send materially different marketing communications.
- information you requested about Fractional CMO services, resources, diagnostics, or programs;
- appointment, scheduling, onboarding, or service-related reminders;
- follow-up communications relating to an inquiry or relationship with Fractional CMO;
- marketing or promotional messages when you have separately consented to receive them; and
- other informational messages that are described at the point of consent.
Message Frequency and Carrier Charges
Message frequency may vary based on your interactions, the service you requested, and the communications program for which you consented. Your mobile carrier may charge standard message, data, or other rates under your wireless plan. Fractional CMO does not control carrier charges.
How to Opt Out or Get Help
You may withdraw consent to recurring text messages by replying STOP to a message from the applicable messaging program. After an opt-out request is processed, you may receive a limited confirmation message. To request assistance, reply HELP when that functionality is supported, or contact Fractional CMO using the information at the end of this Disclosure. If you later want to receive marketing text messages again, a new consent should be collected through an appropriate opt-in process.
Your Mobile Number
You should provide only a mobile number that you are authorized to use. If you stop using or control of a mobile number, you should notify Fractional CMO or update your information so messages intended for you are not sent to another person.
Privacy and Service Providers
Fractional CMO may use service providers to transmit, route, store, or manage SMS/text communications and related consent records. Those providers may process information such as your mobile number, message content, message status, opt-in/opt-out status, and technical delivery information for those purposes. Fractional CMO does not treat consent to receive SMS/text messages as permission for an unrelated third party to market its own products or services to you. Consent Records
Fractional CMO may maintain records reasonably necessary to document an SMS/text opt-in or opt-out. Depending on the form and system used, those records may include the mobile number, date and time of
consent, the consent language shown, the source form or page, and related technical or account information. Website and CRM implementation should preserve timestamped evidence of the consent event and the exact consent language presented at that time.
Changes to This Disclosure
Fractional CMO may update this Disclosure as its messaging practices, forms, service providers, or legal requirements change. The current version should display its effective or last-updated date. A material change to the scope of marketing consent should not be treated as automatically authorized by an earlier consent when new consent is required.
