DMCA Policy

Important: This policy is conditional and should not be published as an active DMCA policy unless Fractional CMO introduces relevant user-generated content and completes the required DMCA agent registration.

This policy is conditional. Publish it as a DMCA safe-harbor policy only if Fractional CMO enables user-generated content or similar hosting functionality, and only after a designated DMCA agent is registered and the same agent information is posted publicly.

Purpose and Scope

This policy describes how Fractional CMO would receive and respond to notices of claimed copyright infringement if the website or related services permit users to upload, post, store, transmit, or otherwise make content available at their direction. It is intended to support a notice-and-takedown process consistent with the Digital Millennium Copyright Act (DMCA), 17 U.S.C. Section 512.

Nothing in this policy expands rights or remedies under applicable copyright law, and Fractional CMO does not represent that every website feature qualifies for a statutory safe harbor.

Notice of Claimed Copyright Infringement

If this policy is activated and you believe material hosted by Fractional CMO infringes your copyright, a written notice should ordinarily include:

  • a physical or electronic signature of the copyright owner or authorized representative;
  • identification of the copyrighted work claimed to be infringed, or a representative list when multiple works are covered;
  • identification of the material claimed to be infringing and information sufficient to locate it, such as the exact page URL;
  • your name and contact information, including address, telephone number, and email address;
  • a statement of good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law; and
  • a statement that the notice is accurate and, under penalty of perjury, that you are the copyright owner or authorized to act for the owner.

Takedown and Review Process

After activation, Fractional CMO may remove or disable access to material identified in a substantially compliant notice and may notify the user who supplied the material. If a notice is incomplete but identifies the work, material, and complaining party, Fractional CMO may seek the additional information needed to evaluate it.

Counter-Notification

A user who believes material was removed or disabled because of mistake or misidentification may submit a counter-notification containing the information required by 17 U.S.C. Section 512(g), including:

  • the user's physical or electronic signature;
  • identification of the removed or disabled material and its prior location;
  • a statement under penalty of perjury that the user has a good-faith belief the material was removed or disabled because of mistake or misidentification;
  • the user's name, address, and telephone number; and
  • consent to the jurisdiction of the appropriate federal district court and acceptance of service of process from the original complaining party or that party's agent.

Repeat Infringement and Misuse

If user-generated content is enabled, Fractional CMO may adopt and reasonably implement a policy for terminating, in appropriate circumstances, users who repeatedly infringe copyrights. Fraudulent or materially misleading notices or counter-notices may expose the sender to liability under applicable law.

This general support address is not represented as the registered DMCA agent unless and until the registration is completed and the published information is updated accordingly.

Important: DMCA safe-harbor procedures are operational, not merely textual. A public policy should be backed by a real intake process, prompt review, a counter-notice workflow, and current agent registration.
